Welcome to SmartSurf Communication. By accessing, subscribing to, or using our internet and telecommunications services, captive portals, website, or mobile applications, you agree to be bound by these Terms and Conditions.
2. Eligibility
You must be at least 18 years of age or have explicit legal guardian consent to register for and use SmartSurf Communication services.
3. Services Provided
SmartSurf Communication provides Wi-Fi hotspot access, residential internet, business bandwidth solutions, network installations, equipment deployment, and related telecommunications services across semi-urban and urban coverage zones in Northern Nigeria.
4. Customer Registration
Customers must provide accurate, current, and complete personal and contact information during registration and keep account records updated at all times.
5. Account Security
You are solely responsible for maintaining the confidentiality of your login credentials, voucher codes, passwords, and account access PINs. All activity occurring under your account is your responsibility.
6. Acceptable Use Policy
Services must be used strictly for lawful purposes. The following activities are strictly prohibited:
- Hacking, network disruption, unauthorized access, port scanning, or vulnerability testing.
- Distributing malware, viruses, spyware, ransomware, or phishing content.
- Sending unsolicited bulk communications (spam) or commercial harvesting.
- Fraudulent activities, impersonation, or financial scams.
- Copyright infringement, pirating, or illegal distribution of protected media.
7. Fair Usage Policy (FUP)
To ensure high network quality and fair access for all subscribers, excessive, automated, or continuous non-standard usage may result in temporary speed management, throughput throttling, or bandwidth prioritization adjustments.
8. Service Availability and Maintenance
While we strive for continuous high availability, services may experience temporary interruptions due to scheduled network maintenance, emergency repairs, upstream ISP outages, adverse weather events, grid power failures, or third-party infrastructure faults.
9. Payments and Subscriptions
All data vouchers, hotspot access passes, and fixed subscription plans must be paid in full in advance through approved digital channels (cards, bank transfers, USSD, mobile wallets) or authorized SmartSurf cash agents.
10. Refunds
Subscriptions and data passes are generally non-refundable once activated or used, except where explicit billing errors occur or as outlined in our official Cancellation & Refund Policy.
11. Subscription Validity
Subscription plans expire automatically upon reaching their specified validity period (hours, days, or months) or upon exhaustion of allocated data quotas, whichever occurs first.
12. Performance Disclaimer
Stated internet speeds represent maximum achievable rates ("up to"). Actual browsing and download performance depends on network signal strength, physical location, channel congestion, server capacity, and customer device hardware capabilities.
13. Customer Equipment
Customers are responsible for ensuring that their smartphones, laptops, routers, and receiving equipment are secure, virus-free, and compatible with SmartSurf network standards.
14. Account Suspension
SmartSurf Communication reserves the right to suspend service access without prior notice in cases of non-payment, chargebacks, policy violations, suspicious network activity, or network abuse.
15. Service Termination
We may terminate customer access, cancel active subscriptions, and close accounts for severe or repeated violations of these Terms or applicable law.
16. Intellectual Property
All SmartSurf Communication branding, logos, website graphics, software interfaces, service names, and content remain the exclusive intellectual property of SmartSurf Communication.
17. Privacy Policy Incorporation
Your personal data and privacy rights are handled in strict accordance with our official Privacy Policy, which is incorporated into these Terms by reference.
18. Customer Responsibilities
Customers agree to use services in compliance with all local, state, and federal laws of Nigeria, maintain security on connected devices, and refrain from commercial reselling of bandwidth without formal authorization.
19. Limitation of Liability
SmartSurf Communication shall not be liable for any indirect, incidental, consequential, or punitive damages. Our total financial liability for any claim shall not exceed the amount paid by the customer for the specific service period affected.
20. Indemnification
You agree to defend, indemnify, and hold harmless SmartSurf Communication, its officers, employees, and agents from any claims, losses, damages, liabilities, or legal fees resulting from your service misuse or violation of these Terms.
21. Force Majeure
SmartSurf Communication is not liable for service failures or delays caused by events beyond our reasonable control, including acts of God, civil unrest, fiber cable cuts, acts of government, cyberattacks, power grid failures, or severe weather.
22. Third-Party Services
Outages, errors, or delays caused by third-party payment gateways, bank networks, mobile operators, or external websites are outside SmartSurf Communication's direct control and responsibility.
23. Changes to Terms
SmartSurf Communication reserves the right to modify these Terms and Conditions at any time. Notice of revisions will be posted on our website or portal. Continued use signifies acceptance of modified Terms.
24. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, and disputes shall be submitted to competent courts within Nigeria.
